SC upholds Hadiya's marriage, NIA probe into criminal dimension to continue

Hadiya's was an'adjustment marriage will consider moving review plea father

Hadiya's father maintained that his daughter's marriage with Shafin Jahan was an act of 'adjustment' done by a group

In response, the Kerala high court had annulled Hadiya's marriage, placing her in the custody of her father after the prosecutors said they feared for her well-being.

The Supreme Court of India finally made a decision on the infamous, seemingly-endless Hadiya case!

But the court said the National Investigation Agency (NIA) would continue its probe into the criminal dimension of the case, if any.

In a judgment that infantlilised an adult citizen of a democracy, the court said: "A girl aged 24 years is weak and vulnerable, capable of being exploited in many ways". SC orders Kerala Police to share with NIA the probe details of the case described by the HC as an instance of "love jihad".

Mr. Asokan's affidavit had mentioned that Ms. Shirin and her husband Mr. Fasal had interacted with Ms. Hadiya in 2015 and even tried to send her to Yemen. On January 6, 2016, Ashokan and Ponnamma filed a missing persons complaint.

Hadiya's father said he will consider to file a review petition in the court.

He attributed the recent momentum toward talks to strict new sanctions applied by the United States. It also acts as a protecting power for the USA in the country.

Earlier, Hadiya's father had claimed before the Supreme Court that his efforts prevented his daughter from being transported to "extremist-controlled territories" of Syria to be used as a "sex slave or a human bomb".

Hadiya then went on to enrol in a religious studies course at Satya Sarani, an educational institution and conversion centre in Manjeri, Malappuram.

Despite Hadiya's pleas, the court in November a year ago, placed her in the custody of her college administration until she completes her education.

However, Hadiya turned up in front of the court two weeks later. Hadiya was provided hostel facility as well. "The court has asked for the NIA probe to continue as the larger question we raised is that Shafin Jahan is a terrorist", he told the media at his house near Kottayam in Kerala.

The order delivered by a Bench headed by Chief Justice Dipak Misra took into account that when Hadiya was summoned to court she admitted to her marriage with Shafin Jahan.
